By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree, you must not use our website or services.

2. Scope of These Terms

These Terms apply to:

  1. Your use of our website and online platforms.
  2. Any enquiry, quote, or reservation made via our website, phone, WhatsApp, email, or in person.
  3. Any car rental, chauffeur, or related service provided by Elite Fleet within the UAE, unless a separate written agreement applies.

Additional terms may appear in your rental agreement, chauffeur agreement, or specific promotion. In case of conflict, the signed agreement or specific terms will prevail for that booking.

3. Eligibility to Rent and Use Services

To rent a car or use our services, you must:

  • Be legally capable of entering into a binding contract.
  • Meet our minimum age requirements (generally 21+; 25+ for certain luxury or high-end vehicles).
  • Hold a valid driving licence acceptable in the UAE. This may include a UAE licence, a recognised foreign licence, and/or an International Driving Permit (IDP), depending on your nationality and visa status.
  • Provide valid identification (passport and visa copy for visitors, Emirates ID for residents).
  • Pass any internal checks we may perform (e.g. payment, security, or risk checks).

We reserve the right, at our sole discretion, to refuse service or rental to any person without obligation to provide a reason, in line with applicable UAE laws.

4. Booking, Confirmation and Contract Formation

4.1 Enquiries and quotes

Rates and vehicle availability given via website, WhatsApp, phone, or email are indicative and subject to confirmation.

4.2 Reservation

Your booking is considered confirmed only when:

  • We accept your request; and
  • You have received a written confirmation (email, WhatsApp, SMS, or booking system); and
  • Any required prepayment or deposit has been received where applicable.

4.3 Contract

A binding rental or service contract is formed when you:

  • Sign the rental agreement or chauffeur agreement; and/or
  • Take delivery of the vehicle; and/or
  • Use our services after receiving confirmation.

We may cancel a booking at any time if you fail to meet eligibility, documentation, or payment requirements.

5. Prices, Taxes and Payment

5.1 Rental rates

Our rates may be quoted:

  • Per day, week, or month;
  • With or without VAT, depending on UAE tax rules and your status;
  • With specific inclusions/exclusions (insurance type, mileage, delivery, etc.).

All charges will be explained in your quote and/or rental agreement.

5.2 Additional charges

You may be charged extra for (as applicable):

  • Salik (toll) usage
  • Traffic fines and penalties
  • Parking fines
  • Extra mileage (if mileage is limited)
  • Additional driver fees
  • Child seats or extras
  • Airport delivery/collection
  • Out-of-hours service
  • Cleaning fees for excessive dirt or smoking in the vehicle
  • Damage repairs and loss-of-use, where applicable

5.3 Payment methods

We may accept:

  • Credit or debit cards
  • Bank transfer
  • Cash (for certain transactions, subject to approval)

Accepted methods may vary by vehicle category, booking channel, and customer profile.

5.4 Security deposit

A refundable security deposit is typically required, held against:

  • Damages
  • Fines and tolls
  • Fuel differences
  • Contract breaches

Deposits are usually blocked on a credit card or held as per our policy and may take time to release depending on your bank and pending fines.

6. Vehicle Collection and Return

6.1 Collection

At collection (or delivery), you must:

  • Present original required documents (passport/Emirates ID, driving licence, etc.)
  • Inspect the vehicle with our staff and note any existing damage
  • Sign the rental agreement and any associated forms

You are responsible for the vehicle from the moment it is handed over to you or your authorised representative.

6.2 Return

You must:

  • Return the vehicle at the agreed date, time, and location
  • Return the vehicle in the same condition (fair wear and tear excepted)
  • Ensure fuel level matches the agreed policy
  • Hand over keys, documents, and any accessories provided

Late returns may incur additional daily/hourly charges as per the rental agreement.

7. Use of the Vehicle

You agree to use the vehicle:

  • Only in a lawful manner and within UAE roads where permitted
  • Only for personal or business transportation purposes (no racing, drifting, off-roading, or illegal activities)
  • Only by drivers authorised in the rental agreement

You must not:

  • Allow unlisted, unauthorised, or unlicensed persons to drive the vehicle
  • Use the vehicle for taxi, ride-hailing, courier, or commercial transport unless expressly permitted in writing
  • Drive under the influence of alcohol or drugs
  • Take the vehicle outside the UAE without our explicit written consent
  • Tamper with the odometer, tracking devices, or vehicle systems
  • Smoke inside vehicles where smoking is prohibited by our policy

Any misuse may result in immediate termination of the rental, full liability for damages, and forfeiture of deposit.

8. Mileage, Fuel and Salik (Toll) Charges

8.1 Mileage

Your rental may include:

  • Unlimited mileage; or
  • A specified daily/weekly/monthly mileage limit.

Excess mileage will be charged at the rate shown in your rental agreement.

8.2 Fuel

Unless otherwise specified:

  • You receive the vehicle with a certain fuel level
  • You must return it with the same level
  • Shortfalls may be charged at a per-litre rate plus service fee

8.3 Salik (toll)

All vehicles are typically equipped with Salik tags. Each passage through a toll gate incurs a fee that:

  • Is recorded during your rental period; and
  • Will be charged to you after the rental once the charges are visible in the system.

9. Insurance, Accidents and Damage

9.1 Insurance

Basic insurance cover is usually included, as required by UAE law. The exact coverage, excess (deductible), and exclusions will be specified in your rental agreement.

Optional additional coverage (e.g. reduced excess, extra protection) may be offered at extra cost.

9.2 Your responsibilities in case of accident or damage

In the event of an accident, theft, or damage:

  • Stop the vehicle safely and call the relevant authorities (e.g. Police – 999).
  • Obtain an official police report and/or accident report.
  • Inform Elite Fleet immediately using the contact details provided.
  • Do not admit liability or negotiate private settlements without our consent.

Failure to obtain the required police or official report may result in full liability for all damage and costs.

9.3 Damage, loss and excess

You may be liable for:

  • The insurance excess stated in your agreement
  • Any damage not covered by insurance (including negligence, misuse, or prohibited use)
  • Loss of use, towing, and related costs where permitted by law

10. Traffic Fines and Violations

You are fully responsible for:

  • All traffic violations, fines, and penalties incurred during your rental period
  • Parking fines, speeding fines, and other road-related violations

Fines may be charged to you after they appear in the official system, along with any admin fee as per our policy. We will provide details on request where possible.

11. Chauffeur Services

If you book a chauffeur service:

  • Only our authorised driver may operate the vehicle
  • The service is limited to agreed hours, routes, and usage scope
  • You must behave respectfully towards our staff and comply with UAE laws and public conduct rules

We reserve the right to withdraw the chauffeur service if you or your guests act in an abusive, illegal, or dangerous manner.

12. Changes, Extensions, Cancellations and No-Show

12.1 Changes and extensions

Extensions are subject to:

  • Vehicle availability
  • Updated rates for the extended period
  • Additional payment and updated agreement if required

You must contact us before the end of your current rental to request an extension.

12.2 Cancellations

Our cancellation policy may vary by booking channel, offer, and season. It will be communicated at the time of booking. Certain bookings may be:

  • Non-refundable; or
  • Subject to cancellation fees.

12.3 No-show

If you fail to appear for collection without prior notice, we may treat it as a no-show and:

  • Cancel the booking; and
  • Retain part or all of any prepayment, subject to our policy.

13. Website Use and Content

13.1 Website content

Our website content (text, images, prices, descriptions) is provided for general information. Although we aim for accuracy, occasional errors or omissions may occur.

We may:

  • Update, modify, or remove content at any time without prior notice
  • Change rates, offers, or availability without updating every page instantly

13.2 No guarantee of availability

Displaying a vehicle or rate on the website does not guarantee:

  • Real-time availability; or
  • Final confirmation at that rate.

Your booking is only confirmed once we issue written confirmation.

14. Intellectual Property

All content on our website, including but not limited to text, graphics, logos, images, videos, and design, is owned or licensed by Elite Fleet and protected by applicable intellectual property laws.

You may:

  • View and print content for personal, non-commercial use only.

You may not:

  • Copy, reproduce, distribute, modify, or use our content for commercial purposes without our prior written consent.

15. Limitation of Liability

To the maximum extent permitted by UAE law:

  • We are not liable for any indirect, incidental, special, or consequential damages, including loss of profit, business, or data, arising from your use of our website, services, or vehicles.
  • Our total liability for any claim arising out of a rental or service shall not exceed the total amount paid by you for that specific rental or service, except where otherwise mandated by law.

Nothing in these Terms excludes or limits liability for death or personal injury caused by our gross negligence or any other liability that cannot be excluded under applicable law.

16. Indemnity

You agree to indemnify and hold harmless Elite Fleet, its owners, employees, and representatives from and against any claims, damages, losses, costs, and expenses (including legal fees) arising out of:

  • Your breach of these Terms or the rental agreement
  • Your violation of any applicable law or third-party rights
  • Your misuse of our vehicles, website, or services

17. Data Protection and Privacy

We process your personal data in accordance with applicable UAE data protection laws and our Privacy Policy.

By using our website or services, you acknowledge that you have read and understood our Privacy Policy, which is incorporated by reference into these Terms.

18. Governing Law and Jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them, shall be governed by and construed in accordance with the laws of the United Arab Emirates.

Subject to any mandatory provisions of law:

  • The courts of Dubai, UAE (or the relevant free-zone courts if applicable to the company’s registration) shall have exclusive jurisdiction over any disputes arising from or related to these Terms, our website, or our services.

19. Language

These Terms may be provided in multiple languages. In case of inconsistency, the English version (or Arabic, if required by law and specified) shall prevail.

20. Changes to These Terms

We may revise these Terms from time to time to reflect:

  • Changes in our services or business practices
  • Changes in applicable laws and regulations
  • Operational or security needs
